Yes. Registered dealers are reminded that they remain ultimately responsible for compliance with their obligations under the Precious Stones and Precious Metals (Prevention of Money Laundering and Terrorism Financing) Regulations 2019.
The screening function is developed to help registered dealers conduct screening against the UN sanction lists and persons identified in TSOFA and Alert list uploaded in myPal. It should only be used for the purpose of screening names against the UN sanction lists and persons identified in TSOFA and Alert list uploaded in myPal. It does not screen names against any other database and must not be used for any other purpose.
The use of this function is voluntary, subject to terms and conditions set by the Ministry of Law, and at the user’s own risk. The Ministry of Law shall not be responsible or liable in any way for any business decision made by registered dealers based on the search results, or any errors in the screening function, the search function of the screening function, the search results presented by the screening function, or the lists uploaded in the screening function.

The screening function is developed to help registered dealers conduct screening against the United Nations (UN) sanction lists and persons identified in Terrorism (Suppression of Financing) Act (TSOFA) and Alert list uploaded in myPal.
It does not screen names against any other database nor for other types of searches e.g. for politically-exposed persons or adverse news, and must not be used for any other purpose.
Regulated dealers are strongly encouraged to document the results of the screening and assessment of the search results.
Under Regulation 13 of the Precious Stones and Precious Metals (Prevention of Money Laundering and Terrorism Financing) Regulations 2019 read with section 18 of the Precious Stones and Precious Metals (Prevention of Money Laundering, Terrorism Financing and Proliferation Financing) Act 2019, the period for which documents and information must be kept is 5 years from the date obtained (i.e. date of search result in this case).
The screening of the customer’s name against the UN sanction lists and persons identified in TSOFA and Alert list is only one of the customer due diligence measures that registered dealers can take. If the search result from the screening is a positive hit, you must decline to enter into or terminate transaction and file a suspicious transaction report (STR). Please be reminded that it is an offence to disclose a STR that was filed or to tip off the customers.
Registered dealers are reminded that they still have to conduct appropriate customer due diligence measures on their customers and transactions. Please refer to the Guidelines for Regulated Dealers for more information.
