Can a bankrupt travel for work?
Bankrupts are allowed to leave Singapore for work with the prior approval of the Official Assignee for the permitted period of travel. Please submit your travel applications at least 14 days before your intended date of travel online at our website (under 'Individual Insolvency' -> 'Insolvent Person's Portal').

What is the Individual Insolvency Search or Bankruptcy Search ?
The Individual Insolvency Search provides members of the public with information on all individuals who are either under the Debt Repayment Scheme or who have been made bankrupt by the High Court of Singapore. The search also provides information on individuals who have been discharged from bankruptcy in the last 5 years.

The status of companies under compulsory liquidation can also be found here.

A fee of $6.00 will be charged for each search.

Note:

A null result is considered a valid search result and a charge will be imposed for the said result.

An annulment of a Bankruptcy Order puts the debtor in the same position as if there had been no Bankruptcy Order made.

Can I obtain information about the bankruptcy estate of my debtor online?
You can access our self-service portal, Individual Insolvency Administration Information (IIAI), through our website (under 'Individual Insolvency' -> 'Creditor's Portal'). There, you can obtain information such as the date the bankruptcy petition was filed, the name of the petitioning creditor, the date of the bankruptcy order, the total claims made against the bankruptcy estate and the total amount in the bankruptcy estate account. Each online search costs $5.

How do I self-petition for bankruptcy or apply for my own bankruptcy?
The Official Assignee does not provide advice on the procedures for filing of a bankruptcy application. You may wish to refer to the Bankruptcy Rules for the procedures. You can obtain a copy of the Bankruptcy Rules online. You may also wish to refer to the Supreme Court's website for further details on bankruptcy proceedings. You should not consider applying for your own bankruptcy as an option to relieve your financial problems. Bankruptcy should be considered as a last resort, as there are restrictions imposed on bankrupts. You may wish to first seek other alternatives to bankruptcy. How does an annulment of a Bankruptcy Order differ from a discharge of a Bankruptcy Order?
An annulment cancels the Bankruptcy Order that was made against the debtor. This means that it is as if the Bankruptcy Order was never made against the debtor. A discharge does not have the same effect.It is important to note, however, that any disposal of the bankrupt's properties or assets by the Official Assignee prior to the annulment of the Bankruptcy Order will remain valid and will not be reversed. Any other properties or assets which were not disposed of prior to the annulment of the Bankruptcy Order will be returned to the debtor.After an annulment of a Bankruptcy Order, the debtor will continue to be liable for any debts that had not been proven against him when the bankruptcy was in force.However, after a discharge from bankruptcy, the bankrupt will no longer be liable for debts that were provable in his bankruptcy (except for debts due to the Government, debts arising from personal injuries caused to a person and debts arising from any order made under the Women's Charter relating to family matters).

Can bankruptcy records be deleted?
Bankruptcy records cannot be deleted as they are official records retained by the Supreme Court.
However, if the bankruptcy order has been annulled, the records will be removed from the Individual Insolvency Search on the date of annulment.

If the bankrupt has been discharged from bankruptcy, the search records/results will be maintained for a period of 5 years from the date of discharge; after which the records will be removed.

What happens when all the shareholders and directors of a Private Limited Company become bankrupt ?
In the event the shareholder of a Private Limited Company is made a bankrupt, the bankrupt's shares in the Private Limited Company vest in the Official Assignee. The Official Assignee will realise the shares for the benefit of the bankrupt's creditors. An undischarged bankrupt is disqualified from acting as a director of a company pursuant to the Companies Act (Chapter 50). If a bankrupt wishes to act as a director of a company, he/she must seek the approval of the Official Assignee or the High Court. As for the company, it will remain in the Accounting & Regulatory Authority of Singapore's (ACRA) records until ACRA strikes it off from the register.

Can a bankrupt borrow money ?
An undischarged bankrupt will be found guilty of an offence if he takes credit or borrows money without first informing that person, at the time the credit is obtained, that the individual is an undischarged bankrupt. You may wish to refer to section 141 of the Bankruptcy Act (Cap. 20, 2009 Rev Ed)/ section 412 of Insolvency, Restructuring and Dissolution Act 2018 for more information on the bankruptcy offences of Obtaining credit, Engaging in business, or Standing as guarantor.

Will I have to terminate my insurance policy if I become a bankrupt ?
Upon the making of the Bankruptcy Order, a bankrupt’s assets vest in the Official Assignee without any further conveyance, assignment or transfer; and become divisible among his creditors. If you have an active insurance policy at the making of your Bankruptcy Order, please contact our office for further advice on this matter. You may wish to refer to section 138 of the Bankruptcy Act Cap. 20, 2009 Rev Ed or section 409 of the Insolvency, Restructuring and Dissolution Act 2018 for more information on the bankruptcy offence of the disposal of assets.

How do I obtain an annulment of the Bankruptcy Order made against me?
You may apply to the court for an annulment of the Bankruptcy Order under section 123 of the Bankruptcy Act (Cap. 20, 2009 Rev Ed)/ section 392 of Insolvency, Restructuring and Dissolution Act 2018 by filing a summons supported by an affidavit stating the reasons why your Bankruptcy Order should be annulled. If the court finds merit in your application, an annulment order will be made. Alternatively, you may apply to the Official Assignee for a certificate of annulment under section 95A or section 123A of the Bankruptcy Act (Cap. 20, 2009 Rev Ed)/ section 358 or section 393 Insolvency, Restructuring and Dissolution Act 2018 . You may wish to seek legal advice on how to file your application for annulment of the Bankruptcy Order.
