Do parents have the right to view the preschool's CCTV footage of their child?
Any parent who requests to view the CCTV footage relating to safety-related incidents involving their child should provide a written request to the preschool. The Preschool’s authorised personnel should attend to the request promptly and make an assessment on the reasonableness of the request.
Preschools are not required to provide parents access to CCTV footage of incidents undergoing investigation by ECDA or Singapore Police Force (SPF) or any other regulatory agency. This includes any serious incidents that occurs during the operating hours of the preschool reported to ECDA via the Incident Management Module in the CMS. (Refer to Chapter 10 of the ECDC Code of Practice (2021) for types of incidents).
This is provided for under the Personal Data Protection Act (PDPA) (2012), unless an exception under the Fifth Schedule to the PDPA applies or the preschool is prohibited from doing so due to prohibitions under sections 21(3) and 21(4) of the PDPA. These considerations also apply to preschool staff who request to view CCTV footage.
