Can the Judge or Tribunal Magistrate refer a case to the Police?
A judge presiding over the matter in the PHC does not “send” cases to the police. However, if the judge is satisfied during a hearing for an application for an EPO that criminal investigation is warranted, the judge may refer the matter to the police for investigation but does not determine whether prosecution ensues. Subsequent action under the criminal process, if any, is separate and distinct from the civil proceedings initiated by the claimant in the PHC.
