What if I can't make it for my Case Management Conference (CMC)?
You may request a change of court date (which is subject to approval). Such request may be made by filing a "Change of Court Date Application" on the Community Justice and Tribunals System (CJTS). Before filing a Change of Court Date Application on CJTS, however, you should start by seeking the written consent of the other party.
If the other party consents to a change of date, you should then obtain (in writing) the other party's unavailable dates and times for at least 3 weeks following the scheduled date for your CMC. You should also identify your own unavailable dates and times. These dates and times will allow the Tribunal to reschedule the CMC to a date on which both parties are available.
Once you have proof of the other party's consent and their unavailable dates and times, you may proceed to file your Change of Court Date Application. In this application, you should: (1) explain why you are unavailable and attach proof of your unavailability (if any); (2) state that you have obtained the other party's consent for the CMC to be rescheduled and attach proof of the other party's consent; and (3) state both yours and the other party's unavailable dates and times as well as proof of the other party's unavailability.
If, however, the other party does not consent to a change of date and you wish to proceed with a Change of Court Date Application, you should inform the other party of your intention. You may then proceed to file your Change of Court Date Application. In this application, you should: (1) explain why you are unavailable and attach proof of your unavailability (if any); (2) state that you have sought the other party's consent but that they have not given it, and attach proof of your communications with the other party; and (3) state your unavailable dates.
In whichever case, you should take steps to file a Change of Court Date Application as early as possible.
