What are the conditions/requirements of a valid Wasiat?

The conditions of a valid Islamic Will (Wasiat) are as follows:


a) Recorded in a written format

- Signed & dated

- At least with 2 Muslim male witnesses (non-beneficiaries)

- Sound mind

- Maximum of 1/3 can be Willed away to non-Faraid beneficiaries


b) The recipients of the distribution through the Wasiat are non-Faraid heirs (such as adopted children, illegitimate children, siblings who do not receive through Faraid, non-Muslim parents, etc.);


c) Requires two witnesses who are not among the recipients of the Wasiat.

Therefore, a Wasiat is often used to give a portion of one's estate to non-Faraid heirs as listed in (b).
