What are the intestate assets/properties that needs to be distributed by Faraid?

Certain types of intestate assets/properties are not subject to distribution according to Faraid. Here are the categories of excluded property:


1. Property owned through Joint Tenancy under the Land Titles Act: Properties owned jointly and registered under the Land Titles Act do not fall under the Faraid rules. Upon the death of one owner, the property automatically transfers to the surviving joint owner(s) based on the Right of Survivorship. The Fatwa Council of Muis issued a fatwa on this in 2019.


2. CPF (Central Provident Fund) Nominations: If the deceased person has nominated someone to receive the CPF funds, these funds belong solely to the nominee and are not subject to distribution under Faraid. The Fatwa Council of Muis has also issued a fatwa on this matter.


3. Life Insurance Payouts to Nominees: As per Section 73 of the Conveyancing and Law of Property Act, life insurance payouts designated to specific nominees do not form part of the deceased's estate. These payouts belong to the nominated individuals and are not distributed through Faraid.


Everything else besides these three categories is subject to Faraid distribution and must be distributed accordingly, unless there is a valid Islamic will (Wasiat) made by the deceased.
