What happens if there is a disagreement between the mutawallis of a wakaf?
Muis encourages all mutawallis to resolve any conflict amongst themselves.
If conflict resolution by or amongst mutawallis is unsuccessful, mutawallis can submit an official request to Muis for assistance. Muis will provide counselling or advisory services to the parties involved.
For complex cases, Muis will arrange for the mutawallis to attend mediation sessions conducted by the Wakaf Dispute Resolution Committee (WDRC). The WDRC comprises experts with legal, Syariah, and alternative dispute resolution backgrounds.
If an agreement is not reached or any party refuses mediation, the WDRC will proceed with an inquiry process. A resolution on the dispute will subsequently be made by the Muis Council, based on recommendations from WDRC.
