What are the criteria to qualify someone to make an LPA, or be appointed as a Donee?

The requirements for making an LPA are:

  • You and your Donees must be at least 21 years old

  • You and your Donees must have mental capacity to make the LPA/accept the appointment as a Donee

  • You must not be an undischarged bankrupt if you wish to make an LPA for property & affairs matters. Similarly, an undischarged bankrupt may not be a Donee for property & affairs matters

  • For the LPA to be valid, it must be registered with OPG.
