While OPGO has simplified the process of making an LPA electronically, safeguards remain in place to protect the Donor and ensure that the LPA is made properly:

• The Donor must still visit an LPA Certificate Issuer (CI) in person. The CI must certify that the Donor understands the purpose of the LPA and the scope of authority granted to the Donee(s), that there is no fraud or undue pressure on the Donor to make the LPA, and that there is no other reason why the LPA should not be created. The CI must be a registered lawyer, medical practitioner accredited by OPG, or psychiatrist.

• The Donor and CI must both digitally sign the LPA during the certification process. They will be redirected from OPGO to Singpass Sign Portal to review and sign. Each signer must log in using Singpass, review the LPA, mark the required section as reviewed, check that the reference code matches, and use the Singpass app to sign. Both signatures must be completed before the CI returns to OPGO and submits the LPA application for registration.

• Donors, Donees and Replacement Donees log in using Singpass. CIs may access OPGO using Singpass or Corppass, but must use their personal Singpass profile to digitally sign because they are certifying in their personal capacity.

• OPG will send SMS or email notifications to all parties (Donor, Donee, replacement Donee) during the LPA application process so that they are kept informed and can alert OPG if there are any issues. Parties may contact OPG at 1800 111 2222 or via https://go.gov.sg/opg-enquiry.

• After an LPA is registered, Donee(s) can only share an electronic copy of the LPA with third parties via OPGO after declaring that the Donor has lost mental capacity. It is an offence for a Donee to make a false declaration.

• OPGO is hosted on the Government Commercial Cloud with appropriate cybersecurity measures.
