What is Section 377A of the Penal Code?

Section 377A of the Penal Code, which criminalised male same sex relations, has been repealed with effect from 1 January 2023. At the same time, Article 156 of the Constitution, which protects the current definition of marriage as between one man and one woman and its related policies from constitutional challenges, was also introduced. This is to ensure the institution of marriage is upheld and safeguarded even as Section 377A is repealed. The Government will continue to uphold the traditional family in all policies and laws flowing from the current definition of marriage, including public housing, education and content regulation.
