What do I need to do to prepare for my hearing?
You should do the following:
Prepare the explanation for your case
You should be prepared to explain your case to the SCT. If your claim or defence consists of smaller parts, you have to explain every individual part in detail.
Example: You should be able to explain every invoice that makes up your claim or the different defects raised in a renovation case.
Submit all your supporting evidence
You should submit all the evidence you want the SCT to consider.
If the evidence is in the form of a document, you should upload it on CJTS. Where the words in any document are not in English, a certified translation of the words into English must be provided.
If the evidence is an audio or video recording, you should copy it onto 2 CDs. Submit 1 CD to the State Courts Service Hub (State Courts, Level 2) and serve 1 CD on the other party. You can do so in advance or during the first consultation.
You should also prepare a transcript of the important part(s) of the audio or video recordings to state the relevant fact (ie, the action that is seen, the exact words that are used, the type(s) of sound(s) that are heard).
Where the words that are used in the audio or video recording are not in English, a certified translation of the words into English must be provided. The transcript must be uploaded into CJTS.
