What are the criteria I must meet before I can file a claim at the Small Claims Tribunal ("SCT")?

You must meet all of the following criteria before you are eligible to file an SCT Claim:

Claim Limit

  1. The value of your claim must not exceed $20,000. The value of your claim may exceed $20,000 where the parties to the claim sign a Memorandum of Consent, in which case the value of your claim must not exceed $30,000.

Type of Claim

  1. Your Claim must relate to one of the following disputes (as outlined in the Schedule of the Small Claims Tribunals Act 1984):

  • (a) a claim relating to a contract for the sale of goods or the provision of services;

  • (b) a claim in tort relating to damage caused to any property (other than a claim mentioned in section 4 of the Community Disputes Resolution Act 2015, or a claim in repsect of damage caused to any property by an accident arising out of or in connection with the use of a motor vehicle);

  • (c) a claim relating to a contract for the lease of residential premises that does not exceed 2 years;

  • (d) a claim by an owner developer for the recovery of any charge or interest mentioned in section 22(1) of the Building (Strata Management) Act 2004;

  • (e) a claim by a management corporation for the recovery of any contribution or interest mentioned in section 40(6) of the Building (Strata Management) Act 2004;

  • (f) a claim by the Housing and Development Board for the recovery of any improvement contribution, interest or penalty mentioned in section 83 of the Housing and Development Act 1959;

  • (g) a claim by the Council of the Singapore Business Federation for the recovery of any subscription mentioned in section 12(4) of the Singapore Business Federation Act 2001;

  • (h) a claim by a Town Council for the recovery of any improvement contribution, interest or penalty mentioned in section 36 of the Town Councils Act 1988;

  • (i) a claim by a Town Council for the recovery of any charge, fee, expense or penalty mentioned in section 73 of the Town Councils Act 1988.

Limitation Period

  1. Your Claim must be filed within 2 years after the date on which the cause of action accrued.

Jurisdictional Restrictions

  1. The party against whom the Claim is commenced must be capable of being served with the Claim in Singapore. Service means the delivery of your Claim personally to that person, or sending that document by registered post to that person's address.

Bankruptcy

  1. An SCT Claim cannot be commenced:

  • If either party is a bankrupt unless you have permission from the Official Assignee.

  • If you are claiming as a corporate entity that is in liquidation or winding up unless you have permission from the Official Receiver or liquidator.

  • If the respondent is a corporate entity that is in liquidation or winding up unless you have permission from the High Court.
