How are assets divided in a divorce?

If you reach an agreement with your spouse on how the assets are to be divided, the agreed terms can be presented to the Family Court for the court's approval and consideration.


If an agreement cannot be reached, the court will determine how the matrimonial assets should be divided. The Women’s Charter provides that the court can consider factors such as the contribution of the parties.
