How is spousal maintenance determined?

In determining the quantum for maintenance, the Women's Charter provides that the Court can consider factors such as the income of each party, the length of the marriage and the standard of living the family had prior to the divorce.
Some examples of spousal maintenance orders include:
A nominal sum
Fixed periodic payments, e.g., every month
One-time lump-sum payment
Ultimately, each case depends on its own facts, and it would be best to seek independent legal advice if you require advice on the merits of your case.
