Can divorced parents still claim Government-Paid Childcare Leave (GPCL) or Extended Childcare Leave (ECL) even without custody and care and control?

Childcare leave is extended to divorced parents regardless of custody, care and control arrangements, as they continue to share responsibility for caring for their children. Both parents are important in a child's upbringing, and the leave scheme enables them to continue fulfiling their parenting responsibilities even after divorce.

As childcare leave is unconditional, employers are not required to determine the parent's intentions before granting leave, as long as eligibility criteria are met.
