Can divorced parents still claim Government-Paid Childcare Leave (GPCL) or Extended Childcare Leave (ECL) even without custody and care and control?

Yes. GPCL and ECL are extended to divorced parents regardless of custody, care and control arrangements. This is because both parents continue to share responsibility for their children's upbringing even after divorce, and the leave schemes are intended to support them in fulfilling their parenting responsibilities.

As childcare leave is unconditional, employers are not required to determine the parent's intentions before granting leave, as long as the eligibility criteria are met.
