Can companies pro-rate parents' employment benefits (e.g., performance assessments, leave entitlements, and bonuses) when the parent takes Unpaid Infant Care Leave (UICL)?

The Unpaid Infant Care Leave (UICL) is a statutory benefit legislated under the Child Development Co-Savings Act (CDCA) and forms part of the overall package to promote marriage and parenthood. Employers should not deter employees from utilising their UICL by tying performance assessments and related bonuses or increments to the consumption of infant care leave.

The UICL will count towards the length of employment period, and the employee's annual leave entitlement should not be pro-rated, as provided under the CDCA.
