Has MSF considered the unintended consequences that severe penalties may have on the operators, including the ability to recruit Board Members and staff? How will MSF prevent such adverse consequences?

Yes, we are mindful of the impact that regulatory actions and criminal penalties would have on SRH operators, as most people joining this sector do so with the best of intentions. We want to support, not penalise, those who are doing their best. The penalties are aligned to that of the Healthcare Services Act, which governs the nursing homes. In the event of regulatory contraventions, MSF will take a graduated approach, e.g. issue administrative warnings and directions at the first instance, and only pursue criminal penalties as a last resort for blatant and egregious issues. MSF will provide clarity on the delineation of roles and responsibilities, provide guidance and training to ensure the different parties understand their legal obligations, and work hand in hand to provide guidance and training so that SRHs can readily meet the regulatory requirements under the Bill when it commences. There will be opportunity for Board members and CEOs to give feedback on their obligations, clarify concerns, and share best practices. Our shared goal is to provide safe, quality care to clients. Through these efforts, we hope to reassure operators, and foster a culture of trust, support and continuous improvement for the sector.
