What does the merits test interview entail?

  • The merits test assesses whether there are reasonable grounds for bringing or defending your case in Court. The assessment will consider:

    • whether you require legal representation to plead guilty;

    • whether there are reasonable grounds for defending your case in Court; or

    • whether there are merits to any criminal appeal or criminal application made or intended to be made by you; or to defend any criminal appeal or criminal application brought by the prosecution, as the case may be.

  • During the interview, you will be asked about the facts of your case, your intended defence (if any) and for supporting documents.
