What are the steps to amend the governing instrument (i.e. trust deed) of a charitable trust?
The steps to amending the governing instrument of a charitable trust is listed as follows:
Submit the proposed amendments to the COC/SA via the Charity Portal. Select “Update Charity Profile” >> “Amendments to Governing Instrument”. Please complete and submit the proposed amendments to Governing Instrument using the template attached within Step 1 of the form. Please upload the proposed amendments to the governing instruments, a copy of the charity’s latest Constitution prior to incorporating the amendments and other relevant supporting documents within Step 1 of the form.
The COC/SA will review and may propose changes or additions.
Upon receipt of the Letter of No Objection from COC/SA, please proceed to seek approval of all amendments at General Meeting as well as any other relevant authority’s approval, in accordance with the charity’s governing instrument.
Submit the charity profile update with the Minutes of Meeting where the amendments were approved and a true copy of the amended trust deed and approval from the relevant authority (if applicable) by completing Step 2 of the “Amendments to Governing Instrument” via the Charity Portal.
