For a 36-month lease agreement that includes a one-month rent-free period, should the stamp duty calculation be based on 35 or 36 months?
Stamp duty on leases is calculated based on the higher of contractual or market rental for the full lease term, including rent-free periods. Therefore, for a 36-month lease with a rent-free month, stamp duty is computed on the full 36 months.
