If you are dissatisfied with an order made by a tribunal magistrate at a hearing, you may appeal to the General Division of the High Court. However, you can only appeal on a ground involving a question of law, or on the ground that the claim was outside the jurisdiction of the tribunal. Before you can appeal, you must first obtain permission from a District Court. You may do so by filing an "Application for Leave/Permission to Appeal" on the Community Justice and Tribunals System (CJTS) and paying the applicable fee. You must file the application on CJTS within 7 days after the date of the order, and serve it on the other party within 7 days after filing. If the other party intends to oppose your application, they must file and serve a response within 7 days after being served. If the District Court grants permission, you must then file and serve a notice of appeal within 7 days after permission is given.

At the time of filing, you must also provide security for the other party's costs of appeal in the sum of $500. Note that filing an appeal does not automatically stop the order from being enforced. If you wish to stop enforcement while the appeal is pending, you will need to apply to a District Court or the General Division of the High Court for a stay. In hearing the appeal, the General Division of the High Court may dismiss the appeal, allow the appeal and set aside or vary the order, or send the matter back to the tribunal for reconsideration. However, the High Court cannot overturn any finding of fact made by the tribunal, and cannot consider any new evidence. The decision of the High Court is final.
