What is a mitigation plea?

After the Prosecution has made their Submissions on Sentence, you will be asked to present your mitigation plea to the Judge. This is for you to raise relevant mitigating facts so that the Judge can consider your case and decide if leniency may be exercised.

If you disagree with the Prosecution’s proposed sentences, you should inform the Court during your mitigation plea and explain why.

The Prosecution will then have a chance to reply to your mitigation plea.
