What does claiming trial mean?

Claiming trial means that you dispute and contest the charge(s) in respect of the offence(s) against you or, disagree with essential facts stated in the Statement of Facts (SOF).

When you claim trial, the following applies:

  1. Trial Date Fixed: - A trial date will be fixed for the Prosecution to prove the charges and for you to defend yourself.

  2. Right to Contest Charges: - You will have the opportunity to contest the charge(s) and present your defence during the trial.
