Why do I still need to physically swear or affirm the Supporting Affidavit and Administration Oath before a Commissioner for Oaths?

After the court processes the initial documents for your probate application, you will need to file your Supporting Affidavit and Administration Oath. You will be able to download the sample forms directly from the Probate eService.

An affidavit is a signed statement of fact made under oath. It is one of the main ways to present evidence to the court.


The Supporting Affidavit and Administration Oath must be sworn or affirmed before a Commissioner of Oaths (CFO). A CFO may be a lawyer, court interpreter, government official or any other individual who is authorised to administer oaths and affirmations.


A directory of CFOs may be found here. Some CFOs provide virtual commissioning services and you may enquire directly with the CFOs regarding these. These services are chargeable by the CFOs.


Please note that you do not need to specifically approach a CFO at the Family Justice Courts to get your Supporting Affidavit and/or Administration Oath sworn/affirmed. CFOs at the Family Justice Courts are also not in a position to certify true copies of documents.
