Should I file my divorce on the normal track or the simplified track?

If you and your spouse are able to agree on the divorce (i.e. the reasons for the irretrievable breakdown of the marriage), the divorce application should be filed on the simplified track. This applies even if you do not have an agreement on the Ancillary Matters.
If you and your spouse are unable to agree on the divorce (i.e. the reasons for the irretrievable breakdown of the marriage), the divorce application should be filed on the normal track.
Ancillary Matters are issues such as children’s care arrangements (custody, care and control and access), maintenance for spouse and/or children, division of matrimonial assets, and costs of the proceedings.
