What is the requirement for under-21 (minor) marriages?

The couple must complete a mandatory Marriage Preparation Programme (MPrep) together before they apply for marriage. Couples need to provide details of the programme they attended i.e. certificate serial number, name of service provider and programme dates when filing for marriage application. The party who is below 21 years old must obtain his/her parents' or guardians' consent as stipulated in the Fourth Schedule of the Administration of Muslim Law Act.


Applicants to note:

  • If both parents are living together, consent must be obtained from both parents.

  • If parents are divorced or separated by order of court or by agreement, consent must be obtained from the parent to whom the custody of the minor is given to, by order of any court or by the agreement.

  • For joint custody cases, both parents of the minor need to give consent.

  • If both parents are deceased, consent must be obtained from the guardian or guardians appointed by the deceased parents or by the court under the Guardianship of Infants Act (Cap.122).


If child is born out of wedlock

Consent must be obtained from the minor's mother or the person who had been granted custody of the minor by order of court. If the mother has passed away, consent must be obtained from the guardian appointed by the mother or by the court under the Guardianship of Infants Act.
