What is the difference between LPA and ACP? If I have made a decision related to my health in the ACP, can the person nominated in my LPA overturn the decision?
An LPA grants your Donee the legal rights to make decisions for you if you’re unable to do so, but it does not tell your Donee what to do for your Personal Welfare.
An ACP helps you to communicate to your Donee, your healthcare team and your loved ones, what decisions they should make for your Personal Welfare. This includes decisions such as where you should live, who you should live with, your daily lifestyle and healthcare decisions.
Appointing the same person as your LPA Donee with Personal Welfare powers and ACP Nominated Healthcare Spokesperson is strongly encouraged as it will help to avoid conflicts amongst your loved ones. However, you do not have to do so, and in that situation, the LPA Donee with Personal Welfare remains the legal decision maker while the NHS is who the healthcare team will consult on healthcare decisions and discussions as the NHS is meant to be your spokesperson.
