Why are parents whose child has passed away eligible for Government-Paid Maternity Leave (GPML) and Government-Paid Paternity Leave (GPPL) but not Shared Parental Leave (SPL)?

Parents whose child has passed away will no longer be eligible for the unused portion of Shared Parental Leave (SPL) upon their child’s death. Appeals will be considered on a case-by-case basis.

 

However, for compassionate reasons, they remain eligible for Government-Paid Maternity Leave (GPML) and Government-Paid Paternity Leave (GPPL) and may fully utilise their entitlements.

 

As the SPL scheme serves as an extension of parental leave, parents will not be able to continue using the remaining SPL if their child has passed on. Should they require additional time away from work, they are encouraged to discuss compassionate leave with their employer or utilise their annual leave entitlements.
