What is a Creditors' Meeting in DRS?

A Creditors' Meeting is a meeting where you, your creditors (people whom you owe money to), and the Official Assignee (“OA”) discuss and finalize your Debt Repayment Plan. During the meeting, the OA conducts further assessment on your suitability for the DRS.

When it happens: After you are assessed as suitable for the DRS but before your Debt Repayment Plan starts (if applicable).

Purpose: To clarify any questions about your financial situation and agree on the specific terms of how you will pay back your debts.

Who attends the Creditors' Meeting?

Required attendees:

●       You (the debtor) - attendance is compulsory

●       Official Assignee (OA) - the case officer managing your case

●       Your creditors - people or companies whom you owe money to

Optional attendees:

●       Your lawyer

What happens during the meeting?

The Official Assignee will:

●       Review your financial information and debt repayment proposal

●       Ask questions about your income, expenses, and assets

●       Explain the DRS process and rules

Your creditors may:

●       Ask questions about your ability to pay

●       Discuss the proposed repayment amount and timeline

●       Raise concerns about your financial disclosure

You will need to:

●       Answer questions about your financial situation honestly

●       Explain any changes in your circumstances since your application

●       Agree to the final repayment terms

Do you have to attend?

Yes, attendance is compulsory. You must attend the Creditors' Meeting unless you have prior written permission from the Official Assignee to be absent.

Valid reasons for absence:

●       Medical emergency requiring hospitalization

●       Overseas work commitment that cannot be rescheduled

●       Family emergency (death, serious illness)

What happens if you don't attend:

●       Without valid reason: You may be found unsuitable for the DRS

●       Without paying the required fee: You may be found unsuitable for the DRS

●       If found unsuitable: Your case will be referred back to the High Court for bankruptcy proceedings

How to prepare for the meeting

Before the meeting:

1.      Pay the required fee: $250.00 review fee must be paid via eCollection before the meeting

2.      Gather your documents:

○       Receipt of the $250.00 review fee paid

○       Updated debt statements, any new financial information

3.      Review your repayment proposal: Make sure you understand and can afford the proposed monthly payments

4.      Prepare to answer questions about:

○       Your current income and job situation

○       Your monthly expenses and living costs

○       Any assets you own

○       Changes since your DRS application

What to bring:

●       Photo identification (NRIC), All requested documents

How to request permission to be absent

If you cannot attend due to a valid reason:

5.      Contact the Official Assignee immediately at 1800 2255 529

6.      Submit a written request explaining:

○       The reason you cannot attend

○       Supporting evidence (medical certificate, travel documents, etc.)

7.      Submit your request at least 7 working days before the meeting

What happens after the meeting

If the meeting goes well:

●       Your Debt Repayment Plan is finalized

●       You will be informed of the date required to pay your first instalment, first annual fee and to acknowledge the terms and condition and debt repayment plan by a specified date.

●       Your DRS payments will start on the date specified in your plan

●       The above is subject to the aggregate of your debts not exceeding the DRS threshold of $150,000 and no new claims from creditors.

If there are issues:

●       meeting may be postponed, additional information may be requested, your case may be reviewed further

Important reminders

●       Arrive on time: Arrive 15 minutes before your scheduled meeting time

●       Be honest: Answer all questions truthfully - providing false information can disqualify you from DRS

●       Ask questions: If you don't understand something, ask for clarification
