Can a solicitor advance payment of solicitor and client costs and disbursements to himself before the Public Trustee's approval?
Unless costs are assessed in default of an agreement with the Public Trustee on the same, a solicitor must not receive or accept any payment of costs and disbursements until costs are agreed with the Public Trustee.
Until an agreement is reached, any payment received by the solicitor must be made into the client's account.
