What is the process after Minister for Law has approved equitable or moral claim against a bona vacantia estate?
For cases where the Public Trustee acts as the administrator of the estate, we will put up a warrant for the Minister for Law to sign once the estate administration is completed. The ministerial warrant will transfer the estate or that part of the estate which is allowed to the claimant.
For estates which we cannot administer due to reasons stated in "What are the situations where the Public Trustee cannot act?", you will have to engage a lawyer to apply for Letters of Administration so that you can administer the estate on your own. We will provide you with a renunciation letter renouncing the Government's right to apply for Letters of Administration. Once the estate administration is completed, you will need to inform the Public Trustee and we will put up a warrant for the Minister for Law to transfer the rights to the claimant.
