What other benefits are there for legally aided persons?

Other than receiving subsidised legal representation, legally aided persons also have certain benefits. A legally aided person:

  • Is not liable for Court fees, fees of process server and any fees due to the Sheriff or bailiff;

  • Is entitled to be supplied free of charge with a copy of the judge's notes of evidence; and

  • Is not liable for costs to any other party even if he or she does not succeed in their claim or defence, except in certain limited circumstances provided under the Legal Aid & Advice Act, for example, if the Court decides that the legally aided person has obtained legal aid through fraud or misrepresentation or has acted improperly in the conduct of their Court proceedings.
