The merits test assesses whether there are reasonable grounds for bringing or defending your case in Court. The assessment will consider:

• whether you require legal representation to plead guilty;

• whether there are reasonable grounds for defending your case in Court; or

• whether there are merits to any criminal appeal or criminal application made or intended to be made by you; or to defend any criminal appeal or criminal application brought by the prosecution, as the case may be.

During the interview, you will be asked about the facts of your case, your intended defence (if any) and for supporting documents.
