Who must register as a charity?

As long as an organisation/trust/foundation is set up for exclusively charitable purposes and carries out activities to achieve these purposes, it must register the organisation/trust/foundation as a charity within three (3) months of its establishment.

 

**Stipulated under Section 7(8)(a) of the Charities Act, it is the duty of the governing board members of any charity which is not registered nor excepted from registration to apply to be registered, and to supply the documents and information required by subsection (7) within 3 months after its establishment or such longer period as the Commissioner may in his discretion allow.
