Is charity considered a legal entity on its own?

No. Charity is a status conferred to the organisation, and does not accord any legal entity status. Hence, an organisation has to be first set up as a legal entity either with the Accounting and Corporate Regulatory Authority (ACRA) as a Company Limited by Guarantee; or with Registry of Societies (ROS) as a society; or as a Charitable Trust before registering as a charity.

 

The type of legal structure an organisation chooses affects how it operates. Hence, do consult professional/legal advice to consider the various requirements and obligations under the respective set-up before deciding how the organisation is to be established.
