Our company intends to transfer a commercial product to our customer for military purposes. Does that classify it as a strategic good?
The determination of strategic goods is based on the technical specifications of the product, whether it meets those stated in the Strategic Goods Control List . It is not based on the end-use of the product. Commercial products that do not meet the specifications of items listed in the Strategic Goods Control List are not classified as controlled, even if they are used for military purposes. However, if you have been notified, know, or have reasonable grounds to suspect that the product is intended or likely to be intended for nuclear, chemical or biological weapons purposes, or missiles capable of delivering these weapons, the item will be subject to the"catch-all" provision under the Strategic Goods (Control) Act.
